1. Acceptance of Terms

By downloading, installing, accessing, or using the Lullaby AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Lullaby AI ("we," "our," or "us").

We reserve the right to modify these Terms at any time. Changes become effective upon posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Service Description

Lullaby AI is an AI-powered mobile application that generates personalized bedtime stories for children ages 2–12. The App uses:

• Google Gemini API to generate unique, age-appropriate story text based on the child's name, age, theme, mood, and selected language.
• OpenAI TTS to narrate stories aloud with a calming preset voice.
• Lemonfox (Premium only) to clone a parent's voice for personalized narration.

Stories are generated in real-time and saved locally on your device using Apple's SwiftData framework. Each story is unique and created specifically for your child.

3. Eligibility & Parental Responsibility

• You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App and make purchases.
• The App is designed to be operated by parents or legal guardians on behalf of their children.
• By using the App, you represent that you are a parent or legal guardian authorized to provide information about the child for whom stories are being created.
• You are responsible for supervising your child's interaction with any content generated by the App.

4. Subscription Tiers & Pricing

5. Free Trials & Auto-Renewal

• A 3-day free trial is available for both the Weekly and Yearly subscription plans.
• When you start a free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your Apple ID will be automatically charged the subscription price.
• Subscriptions automatically renew at the end of each billing period (weekly or yearly) unless cancelled at least 24 hours before the renewal date.
• You can cancel your subscription at any time through your Apple ID settings: Settings → Apple ID → Subscriptions → Lullaby AI → Cancel Subscription.
• Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

6. Refunds

All purchases and subscriptions are processed through Apple's App Store. Refund requests must be submitted directly to Apple through their standard refund process. We do not control Apple's refund decisions. To request a refund, visit reportaproblem.apple.com.

7. AI-Generated Content

• All stories generated by Lullaby AI are created by artificial intelligence and are unique to each generation request.
• While we implement safety filters and content guidelines, AI-generated content may occasionally produce unexpected results. Parents should review stories if they have concerns.
• Stories generated through Lullaby AI are provided for personal, non-commercial use. You may share stories with family and friends.
• We do not claim ownership over stories generated for you. However, you acknowledge that similar stories may be independently generated for other users.

8. Intellectual Property

The Lullaby AI application, including its design, branding, logos, user interface, and underlying technology, is owned by Lullaby AI and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App or its content (excluding your generated stories).
• Reverse engineer, decompile, or disassemble the App.
• Use the App's name, logos, or branding without prior written permission.
• Use the App for any commercial purpose beyond personal family use.

9. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to bypass subscription restrictions or manipulate free trial eligibility.
• Use automated systems to generate stories at scale for redistribution.
• Attempt to access other users' data or interfere with the App's operation.
• Submit prompts designed to generate inappropriate, harmful, or offensive content.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We do not guarantee uninterrupted or error-free service.
• AI-generated stories may not always meet expectations. Content is generated algorithmically and may vary in quality.
• We are not responsible for any decisions made based on AI-generated content.
• Story generation depends on third-party AI services (Google Gemini, OpenAI) which may experience downtime or changes.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LULLABY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App.
• Any content generated by the AI service.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content on the App.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time if you violate these Terms or engage in fraudulent or abusive behavior. Upon termination:

• Your right to use the App ceases immediately.
• Locally stored stories remain on your device.
• Active subscriptions must be cancelled separately through your Apple ID settings.

You may stop using the App at any time. To delete all associated data, simply uninstall the App from your device.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
